§1. GENERAL PROVISIONS
The owner of the Online Webshop is the Museum of King Jan III's Palace at Wilanów, ul. Stanisława Kostki Potockiego 10/16, 02-958 Warsaw; having legal personality, entered into the RIK register maintained by the Minister of Culture and National Heritage under No. 39/95; NIP 951-00-54-672, REGON 010956038, bank account number 12 1130 1017 0020 1226 4720 0004 maintained by Bank Gospodarstwa Krajowego, hereinafter referred to as the Seller.
These Terms and Conditions set out the conditions and rules for placing orders and making purchases in the Online Webshop of the Museum of King Jan III's Palace inat Wilanów at the internet address sklep.wilanow-palac.pl, hereinafter referred to as the Online Webshop.
Each person placing an order is obliged to read the Terms and Conditions. In the following part of these Terms and Conditions, the person placing the order is referred to as the Customer. By creating an account or placing an order, the Customer confirms that they have read these Terms and Conditions.
These Terms and Conditions shall specify in particular: a) conditions and rules for placing orders electronically in the Online Webshop; b) rules for concluding sales agreements using the services provided within the Online Webshop; c) complaint and withdrawal procedures.

The Customer can access the Terms and Conditions in the form of a PDF file, download it and print it out. The parties are bound by the version of the Terms and Conditions in force at the time of placing the order; any changes to the Terms and Conditions do not affect the rights of the Customer arising from orders placed before the changes were made.
The Customer is obliged to use the Online Webshop in accordance with the provisions of law in force in the territory of the Republic of Poland, the provisions of the Terms and Conditions, as well as general rules for using the Internet. It is forbidden to provide illegal content, such as content that promotes violence, or content that defames or violates the personal and other rights of third parties.
The correct use of the Online Webshop is possible provided that the ICT system used by the Customer meets the following minimum technical requirements: - web browsers: Mozilla Firefox, Internet Explorer 7.0 - optimal screen resolution: 1152 x 768 px
§2. PURCHASING PROCEDURE
The Customer may be a natural person with legal capacity or a legal person.
Information about the goods provided on the Online Webshop's websites, in particular their descriptions, technical and performance parameters and prices, constitute an invitation to conclude a sale agreement within the meaning of Art. 71 of the Civil Code and do not constitute an offer within the meaning of Art. 66 of the Civil Code.
The offer of the Online Webshop is limited to the area of the Republic of Poland.
Placing an order comprises the correct completion of the "order form" located on the Online Webshop's website - sklep.wilanow-palac.pl. The Seller is not responsible for incorrect completion of the form or incorrect payment by the Customer.
The order sent by the Customer constitutes a statement of the will to conclude a sales agreement.
As confirmation of receipt of the order by the Seller, the Customer receives an electronic confirmation of acceptance of the order for execution. The absence of such confirmation is tantamount to non-acceptance of the order for execution. Any doubts should be clarified by phone at +48 22 5442 840 or electronically by contacting the Seller at sklep@wilanow-palac.pl.
Orders can be made 24 hours a day throughout the entire year. Orders placed after 4 p.m. on weekdays, Saturdays, Sundays and public holidays will be considered in the order of receipt from 8 a.m. the next working day. In the case of orders containing a larger number of products, the Seller reserves the right to execute them within a longer period than provided for in the Terms and Conditions, after informing the Customer by e-mail to the Customer's e-mail address.
The order is confirmed by the Seller via email within 24 hours on working days. If it is not possible to confirm the order through the fault of the Customer within 7 working days (e.g. wrong phone number or email address), the order is considered to be not confirmed and will be cancelled.
The agreement shall be deemed to have been concluded at the time of the confirmation referred to above (paragraph 8).
The provisions of the sale agreement will be fixed, secured, made available and confirmed to the Customer by attaching a sales document to the shipment containing the goods.
§3. PAYMENTS, ORDER EXECUTION
The condition for the execution of the order is the correct completion of the form on the website sklep.wilanow-palac.pl and compliance with the conditions described in §2 of the Terms and Conditions.
The bank account number of the Museum of King Jan III's Palace inat Wilanów, to which transfers should be made, is: 12 1130 1017 0020 1226 4720 0004 (BGK)
When placing an order, the Customer should choose one of the available means of payment: - traditional transfer - electronic transfer If the Customer has chosen the traditional transfer option, failure to transfer to the account within 14 days from the date of confirmation by the Seller of the order will result in withdrawal from the purchase and sale agreement by the Seller.
All prices presented in the Online Webshop are expressed in Polish zloty and are gross prices including VAT. The price presented for a given product is binding for the Customer at the time of placing the order. Prices do not include delivery costs.
The price stated in the order confirmation is binding for the Seller.
Some of the offered products may not be available at a given moment; the Seller shall inform the Customer of this by email to the Customer's email address.
§4. SHIPPING AND RECEIVING ORDERS
Orders are processed within 2 to 5 working days from the date of recording the payment in the Museum's account. This period does not include the time required for delivery.
Shipping of orders is carried out with the assistance of the courier company InPost. When approving the order, the Customer chooses the form of payment and shipping. The cost of shipping carried out only in Poland is indicated on the website https://sklep.wilanow-palac.pl/pl/i/Czas-i-koszty-dostawy/4 and is added to the order amount.
The delivery time is a maximum of 30 days. If the ordered product is in the Seller's warehouse at the time of placing the order, the delivery time is a maximum of 14 working days. Delivery charges are calculated individually for each item and specified during the order. When the Customer receives the order, they have the right to check the completeness of the contents of the parcel; in the case of mechanical damage or incompleteness of the contents of the parcel, a damage report must be written in the presence of the courier. The protocol should be drawn up in two identical copies and signed by the courier and the Customer. After the protocol is drawn up, information about the situation should be sent as soon as possible to the email address sklep@wilanow-palac.pl. Drawing up a protocol will speed up and facilitate the process of complaint of damage during transport.
§5. COMPLAINT PROCEDURES
The Seller is liable to the Customer for non-compliance with the agreement of the goods purchased by the Customer under the conditions specified by the Civil Code and the Act of May 30, 2014 on consumer rights (i.e. Dz. U. of 2020 item 287, and 2021 item 21057); this is for a period of two years from the date of issue of the goods. Complaints in writing should be sent to the address of the Seller: Museum of King Jan III's Palace at Wilanów, ul. St. K. Potockiego 10/16, 02-958 Warsaw, with the note "online webshop"
In the complaint, the Customer should indicate their name, address for correspondence, receipt/invoice number, type and date of non-compliance of the goods with the agreement.
The Seller is obliged to consider the complaint within 14 days of receipt of goods.
The Online Webshop is not liable for damages resulting from the misuse of the goods offered.
Complaints regarding the provision of services by electronic means: a) the Seller takes measures to ensure the fully correct operation of the Online Webshops's website, to the extent that it results from current technical knowledge and undertakes to remove within a reasonable time any irregularities reported by Customers.
b) the Customer should immediately notify the Seller of irregularities or interruptions in the operation of the Online Webshop's website.
c) the Customer may report irregularities related to the operation of the Online Webshop by e-mail to sklep@wilanow-palac.pl.
d) in the complaint, the Customer should provide his/her name, address for correspondence, type and date of occurrence of irregularities related to the operation of the Online Webshop.
§ 6. RIGHTS AND PROCEDURES FOR WITHDRAWAL FROM THE SALE AGREEMENT
The Customer has the right to withdraw from an agreement concluded at a distance, without giving a reason, by submitting an appropriate statement in writing (an example of which can be found under these Terms and Conditions) within 14 days, sending it to the Seller's address by email to sklep@wilanow-palac.pl or to the address of the registered office of the Seller: Museum of King Jan III's Palace w Wilanów, ul. Stanisława Kostki Potockiego 10/16, 02-958 Warsaw. The 14-day period is counted from the date of receipt of the goods.
In order to exercise the right to withdraw from the sales agreement, it is sufficient to send a statement indicating the intent to exercise this right before the expiry of the withdrawal period indicated above.
If the Customer withdraws from the sale agreement, the Museum of King Jan III's Palace at Wilanów is obliged to immediately, but not later than within 14 days from the date of receipt of the Customer's statement of intent to withdraw from the sale agreemnt, return to the Customer all payments received from the Customer, including delivery costs (except for additional costs that may arise in connection with the Customer's choice of a different delivery method than the cheapest, usual delivery method offered by the Online Webshop). The same means of payment used by the Customer during the purchase transaction is used for the refund, unless the Online Webshop explicitly agrees with the Customer on another means of payment. The Online Webshop will not charge the Customer for this. The Museum of King Jan III's Palace at Wilanów may withhold the refund of the payment received from the Customer until the time of receipt of the return of the goods or until the Customer provides proof that the goods were sent to the Museum of King Jan III's Palace at Wilanów, depending on which of these events occurs earlier. All refunds are made automatically to the bank account number used by the Customer for payment. If payment is made by by credit card, the amount will be refunded to the credit card account.
Immediately after receiving from the Customer a statement of intent to withdraw from the sales agreement, regardless of whether it was made by mail or in the electronic form provided for in paragraph 3 above, the Online Webshop will confirm receipt of the Customer's statement.
By withdrawing from the agreement of sale of goods, the Customer is obliged to immediately return the purchased goods to the address: Museum of King Jan III's Palace at Wilanów, ul. Stanisława Kostki Potockiego 10/16, 02-958 Warsaw, however, no later than within 14 days from the date on which the Customer submitted a statement of withdrawal from the sales agreement. The deadline is considered to be met if the goods are shipped before the expiration of 14 days.
The Customer is responsible for any reduction in the value of the product resulting from the use of it in a way that goes beyond what is necessary to establish the nature, characteristics and functioning of such an item. In order to determine the nature, characteristics and functioning of the item, the Customer may normally open or unpack the package to check the characteristics and functioning of the item and examine it in the manner customary in stationary shops.
By accepting these Terms and Conditions, the Customer confirms receipt of information about the right of withdrawal.
§7. PROTECTION OF PERSONAL DATA
The Controller of personal data of Customers of the Online Webshop is the Museum of King Jan III's Palace at Wilanów with its registered office at ul. Stanisława Kostki Potockiego 10/16, 02-958 Warsaw. The Controller can be contacted via e - mail: muzeum@muzeum-wilanow.pl or in writing to the address of the registered office indicated above.
A data protection officer has been appointed at the Museum, who can be contacted by e-mail: iod@muzeum-wilanow.pl in all matters relating to the processing of personal data and the exercise of rights related to data processing.
The collected data will be processed exclusively for the purposes related to the implementation of the sale agreement for goods ordered in the Museum Online Webshop, including for handling the order placed, issuing an invoice and conducting financial reporting, as well as investigating possible claims arising from the agreement.
The legal basis for data processing resulting from regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as the GDPR):
a) taking the necessary measures regarding the conclusion and execution of the sales agreement in the Online Webshop of the Museum, in relation to Article 6(1)(b) of the GDPR;
b) compliance with legal obligations in accordance with Article 6(1)(c) of the GDPR defined by accounting regulations and tax regulations, in particular when personal data are part of accounting documentation;
c) the legitimate interest of the Museum referred to in Article 6(1)(f) of the GDPR, related to the investigation or denial of any claims arising from a sale agreement.
Personal data will only be made available to entities through which the Museum executes the order, including courier companies and payment operators, to the extent appropriate for this purpose.
The collected data may also be transferred to entities processing personal data on behalf of the Museum, including entities operating IT systems related to the operation of the Online Webshop, and such entities process data on the basis of an agreement with the Museum and only in accordance with its instructions.
Personal data will be stored: a) until a Customer unsubscribes from the Online Webshop (in the case of registered users);
b)for the duration of the sale agreement, and after its termination for the time associated with the expiration of claims related to the agreement and for the time specified by tax regulations and financial reporting.
Each person has the right to: access to the data and to receive a copy of the data, request their correction, deletion or restriction of their processing, as well as the right to object in the case of data processing based on the legitimate interest of the Museum referred to in point 4(c) above.
Each person also has the right to transfer personal data, i.e. to receive personal data from the Museum in a commonly used electronic format, which can be sent, depending on the need, to another data controller.
In order to exercise the above rights, contact the Museum or the data protection officer using the contact details indicated above in Paragraphs 1 and 2.
Each person also has the right to lodge a complaint with the president of the Office for Personal Data Protection.
Provision of data is voluntary, but necessary for placing an order and performing a sale agreement.
§8. FINAL PROVISIONS
The settlement of any disputes arising between the Seller and the Customer shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Code of Civil Procedure.
In matters not regulated in these Terms and Conditions, the provisions of the Civil Code and the provisions of the Act on consumer rights of 30 May 2014 and other relevant provisions of Polish law shall apply.
§9. INTELLECTUAL PROPERTY
It is forbidden to use any materials published on the website of the Online Webshop owned by the Seller (including photos and descriptions of goods) without the written consent of the Seller.
